1. PREMISE
These conditions are inspired by and comply with the quality principles adopted by Elettrodomex Srl and with the concept of Global Quality in the Client/Supplier relationship. Therefore their spirit is not the protection of the supplier's interests but the achievement of the best level of collaboration between both parties, at the service of the primary interest of the final customer. The form is therefore that of an agreement between the client and the supplier, who undertake in good faith to respect certain rules useful for achieving global quality in their technical/commercial relationship.

2. WARRANTY
The supplier guarantees the good quality of its products by undertaking, during the guarantee period specified below, to repair (at its own workshops) or replace free of charge as soon as possible those parts which prove to be defective, provided that this does not depend on faults caused by inexperience or negligence of the customer, by use outside the technical specifications, by unauthorized interventions, by chance or force majeure. The warranty period is 24 months from the date of sale for CE marked products.

3. TECHNICAL INFORMATION
The technical information is based exclusively on the data published by the manufacturers. We reserve the right to modify and/or adapt the technical and dimensional parameters on the basis of what will be communicated to us by the producers, even without any notice.

4. ORDERS
Orders are accepted from our offices or directly on the web. The customer will have confirmation of the order by receiving an e-mail or with a specific online notice that can be saved. The faculty of Elettrodomex Srl remains unaffected, should it detect anomalies of any kind and for any reason (incongruous prices and/or out of stock products for example) to refuse the order received by promptly informing the customer.

5. PRICES
All prices entered on the ShopClima.it website are net prices to the public including VAT (22%), unless otherwise specified. Elettrodomex Srl reserves the right to change the published prices at any time and without notice.

6. SHIPPING & DELIVERY
Shipments, unless specifically requested, will be made by carriers defined by Elettrodomex Srl or its delegate. In the event of theft and/or loss, Elettrodomex Srl therefore undertakes to send a new product. In case of withdrawal of the goods by the customer, Elettrodomex Srl declines any responsibility after the goods have left its warehouses. The delivery time is estimated from two to five working days, unless otherwise requested or specific agreements.

7. RISK & OWNERSHIP
The goods are shipped free port with charge on the invoice; in the event that the goods were sent carriage forward following the customer's indication, the risk is to be considered borne by the customer from the moment of collection of the goods from our warehouses. At the time of delivery, the customer must verify the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the accompanying document. In case of discrepancy, the same must be promptly reported by email to Elettrodomex Srl. In case of non-intact packaging, the customer must sign with specific reserve and verify the qualitative and quantitative correspondence of the goods delivered with what is indicated in the accompanying document within 3 days. In the presence of intact packaging, the goods must be checked within 8 days of receipt. Any anomalies must be immediately communicated via email. Any notification beyond the indicated deadlines will not be taken into consideration. Complaints received by telephone will not be accepted in any way.

8. PAYMENTS
The goods supplied by Elettrodomex Srl, through the ShopClima.it website, can be paid by: credit card with a specific online procedure, PayPal and advance bank transfer. Elettrodomex Srl reserves the right not to ship goods, even after accepting the order, to customers who are "insolvent".

9. RIGHT TO CANCEL ORDERS
The customer may request the cancellation of the order not yet packed and Elettrodomex Srl reserves the right to accept the cancellation of the same. The cancellation must be made in writing within 14 working days of receipt of the goods, even without giving reasons from the customer. Elettrodomex Srl reserves the right not to accept the cancellation itself if the goods had been expressly ordered from its supplier to fulfill the order in question and for some specific items. Furthermore, Elettrodomex Srl, if it were unable to process the requested order due to the unavailability, even temporary, of the ordered product, has the right to withdraw from the sales agreement within 30 days from the date of the order by providing the customer with a simple reasoned communication, pursuant to art. 54, paragraph 2 of Legislative Decree 206/05. In this case, the customer will only be entitled to a refund of any sum already paid.

10. RIGHT OF WITHDRAWAL AND RETURN OF GOODS
The right of withdrawal is guaranteed and regulated in accordance with the law by articles 64 et seq. of the Consumer Code (Legislative Decree 2005/206). The return of goods to Elettrodomex Srl must be requested and possibly authorized in advance by contacting our offices explaining the reasons for the request and quoting the invoice and/or transport document (DDT) references. Before returning the goods, it is necessary to wait for the written authorization and the assignment of an appropriate return number. The goods to be returned must be in perfect condition, sent in the original packaging and sent carriage paid to our warehouse, quoting the assigned return number on the document and attaching the appropriate return condition acceptance form duly completed and signed for acceptance by an authorized person.

11. CLAIMS
Any shipping errors or material shortages must be reported in writing according to the times indicated in point 7 (risk and ownership).

12. LIABILITY & DISPUTES
Elettrodomex Srl is not responsible for losses and/or damages (direct or indirect) deriving from delayed or non-delivery of the product, nor for any other fact not directly attributable to Elettrodomex Srl. Regardless of laws or customs, customer and supplier acknowledge the discussion in good faith of any problems as the best means for the realization of a mutual comprehensive quality relationship. They therefore undertake to clarify any dispute (which cannot be remedied by direct discussion) without recourse to legal action, i.e. solely by means of the arbitration clause referred to in the next point. They also explicitly acknowledge, with the acceptance of these conditions, the total value of the supply as the maximum limit of economic responsibility for each of the two parties.

13. ARBITRATION CLAUSE
Any disputes arising between the parties will be decided by arbitrators appointed one by the supplier and the other by the customer. The arbitrators thus appointed will appoint a third arbitrator. In the absence of an agreement, the latter will be appointed by the President of the Milan Chamber of Commerce. The arbitration panel will decide irrevocably, unquestionably and without appeal to any other level of judgment by either party.

14. SECURITY & PRIVACY
Law 675/96 guarantees that the processing of personal data is carried out in compliance with the rights, fundamental freedoms, as well as the dignity of natural persons, with particular reference to confidentiality and personal identity. Pursuant to art. 10 of the aforementioned law, we inform you that the processing of personal data, which will take place through a specific IT method, has the purpose of proceeding with the execution of the contract. Where necessary, we will pass on the data to the shipping companies in charge as well as to the other companies involved in the various stages of the sales process. This provision of data is essential to Elettrodomex Srl for the execution of the sales contract. We also inform you that such data may be used for the purpose of providing information on initiatives, events, promotions and product launches. For the same purpose, the data may only be communicated to companies connected to us. In any case we will not use the information in our possession for purposes other than those mentioned above. The rights provided for by art. can be exercised at the competent offices. 13 of law 675/96. Furthermore, pursuant to Legislative Decree 196 of 30.6.2003, you can request to stop receiving messages from us at any time by sending an e-mail to info@shopclima.it inserting the following text in the subject: unsubscribe.

15. NOTE
The conditions contained in this document may be modified without notice and will be valid from the date of publication on the website www.shopclima.it which is always our official reference (last update on 30/11/2022).

16. REFERENCE LEGISLATION
All the contracts concluded are understood to have been finalized in Italy and are subject to the Italian laws that regulate remote commerce, in particular the law 675/96, the ministerial decree 185/99 and the Legislative Decree 196 of 30.6.2003.

17. ONLINE CONSUMER DISPUTE RESOLUTION (ODR)
The consumer residing in Europe must be aware of the fact that the European Commission has set up an online platform for alternative dispute resolution which provides an out-of-court method for resolving any disputes relating to and resulting from the assumption of online sales and contracts of service. Consequently, if you are a European consumer, you can use this platform for the resolution of all disputes arising from the contract stipulated online with the owner.
